Sole proprietor Artem Vitalievich Potykun (OGRNIP 325508100092492, INN 504418067410), "HireHub", offers a natural person with full legal capacity, including one applying the special tax regime "Tax on Professional Income", or a sole proprietor, the "Specialist", to enter into a contract for paid services on the terms of this offer. The offer is a public offer under Article 437 of the Civil Code of the Russian Federation.
1. Terms
1.1. Platform: the HireHub service, meaning the website h1rehub.ru, the application app.h1rehub.ru, the HireHub Telegram bot and the programming interface (API and MCP server).
1.2. Account: the Specialist's account on the Platform.
1.3. Task: an assignment of HireHub placed on the Platform with a description, a deadline and a remuneration. A Task is seen by the Specialist and by the persons on whose behalf HireHub sets tasks ("HireHub's clients").
1.4. Balance: the Specialist's ruble account on the Platform, which records the accrued remuneration.
1.5. Payout profile: the Specialist's payout data: tax status, INN, bank details.
1.6. Platform Rules and Tariffs: documents published on the Platform. They form part of this contract.
2. Subject of the contract
2.1. The Specialist, on HireHub's instructions, provides the services and performs the work described in Tasks, and HireHub accepts and pays for them.
2.2. Each Task the Specialist takes is a separate assignment under this contract. The Specialist decides whether to take a Task and organises the work alone, choosing the time, place and methods. The contract is not an employment contract and sets no working hours. The Specialist may provide services to other persons who are not HireHub clients, including outside the Platform.
2.3. The Specialist performs Tasks personally. Third parties may be engaged only with HireHub's consent.
2.4. The Specialist talks to HireHub's clients in the Platform messenger and comments. HireHub's clients are not parties to this contract; only HireHub owes payment to the Specialist.
3. Conclusion of the contract
3.1. The contract is concluded by accepting this offer: by pressing the document acceptance button in the application or by confirming in the HireHub Telegram bot after reading the offer. By accepting the offer, a natural person confirms that they are 18 years old or have acquired full legal capacity.
3.2. The Specialist may register on the Platform and fill in the profile before registering as a payer of the tax on professional income or as a sole proprietor. The Specialist may take paid Tasks after the status is registered and checked by the Platform.
3.3. Actions in the Account and in the Telegram bot are deemed signed with a simple electronic signature under section 10.
3.4. HireHub parses the resume that a Specialist sends for admission to Tasks automatically, using the artificial intelligence models named in the Privacy Policy, and fills in the Specialist's profile from it. The Specialist reviews the profile and may correct any field before the profile is sent to the catalogue.
3.5. HireHub opens admission to Tasks on the basis of the resume, the profile and the portfolio. The first analysis of the resume is performed by an automated system based on the artificial intelligence models named in the Privacy Policy. It may open admission for a Specialist on its own if the resume meets the criteria of the Platform Rules. It does not refuse admission: a refusal is made by a HireHub staff member, who reads the resume and the reason the system suggested.
3.6. A Specialist who disagrees with an admission decision, or who wants a staff member to look at the resume again, sends an objection through Platform support. HireHub considers the objection with the participation of a staff member within 30 days of receiving it and reports the result in the Telegram bot or in the Account.
4. Remuneration
4.1. The Specialist's remuneration is determined as follows:
- for an hourly Task, the hourly rate the Specialist set in the profile and that was in force when the time was tracked, multiplied by the accepted hours;
- for a fixed-price Task, the amount shown to the Specialist on the Task page before taking it.
4.2. The remuneration is full payment for the services and for the alienation of rights to the result. There are no other payments under the contract.
4.3. The terms of HireHub's contracts with its clients are confidential and do not affect the Specialist's remuneration.
4.4. The Specialist may change the hourly rate in the profile. The new rate applies to time tracked after the change.
4.5. Hours are accepted when HireHub's client accepts them or does not dispute them within the period set in the Platform Rules. The result of a fixed-price Task is accepted when HireHub's client accepts it or sends no remarks within 5 calendar days after delivery. From acceptance, the remuneration is accrued to the Specialist's Balance.
5. Payouts
5.1. The remuneration is paid only to a Specialist who is a payer of the tax on professional income or a sole proprietor and has filled in the Payout profile. If the Specialist has not registered the status yet, the Platform shows how to do it.
5.2. A Specialist paying the tax on professional income links themselves to JSC "TBank" as a partner in the "My Tax" application. The Platform checks the link and the taxpayer status with the Federal Tax Service before paying.
5.3. The Specialist creates a withdrawal request in the Account for at least the minimum amount shown in the interface. Requests created before 18:00 Moscow time are included in that day's payout.
5.4. Every day after 18:00 Moscow time HireHub prepares, at JSC "TBank", a payment registry for the self-employed and payment orders for sole proprietors, signs them and transfers the money to the bank account in the Payout profile. The crediting time depends on the recipient's bank.
5.5. A Specialist paying the tax on professional income issues a receipt for the amount received in the "My Tax" application within the periods set by Federal Law No. 422-FZ. If JSC "TBank" issues the receipt for the Specialist through the link, the obligation is fulfilled. If no receipt is issued or it is cancelled, the Specialist issues it on their own.
5.6. A Specialist who is a sole proprietor confirms that payout acts are generated by the Platform and signed with a simple electronic signature.
5.7. HireHub is not the Specialist's tax agent. The Specialist pays the taxes on their income.
5.8. The Specialist reports the loss of the status of a payer of the tax on professional income or of a sole proprietor through Platform support within 1 business day. Payouts are suspended until the status is restored.
6. Rights to results
6.1. The exclusive right to a result created under a Task passes to HireHub in full from the moment the result is accepted. HireHub may transfer this right to its client. The remuneration for the alienation of the right is included in the Task remuneration.
6.2. The Specialist warrants that the result is created personally or with materials whose rights allow such use, and does not infringe third-party rights.
6.3. The Specialist may show the result in the portfolio on the Platform unless HireHub's client has forbidden it on the Task page.
7. Specialist's obligations
7.1. The Specialist undertakes to:
- provide accurate data in the profile, resume and Payout profile;
- perform Tasks well and within the deadlines on the Task page;
- track time honestly, only for actual work on the Task;
- keep confidential the information received while performing Tasks;
- not exchange contact details with HireHub's clients and not arrange work or payment outside the Platform;
- follow the Platform Rules.
7.2. The automatic checking of correspondence, Tasks, comments, files and images on the Platform for compliance with the Platform Rules is part of HireHub's services under this contract. The procedure for checking is set by clause 2.3 of the Platform Rules.
8. Liability and disputes
8.1. The parties are liable for non-performance under the laws of the Russian Federation.
8.2. If HireHub's client disputes hours or a result, the dispute is handled on the Platform under the Platform Rules. The decision determines which part of the remuneration is accrued to the Specialist.
8.3. A claim is sent to HireHub's e-mail or through Platform support. The reply period is 15 calendar days, or up to 45 calendar days if a review or additional documents are needed. A party asked for documents under a claim provides them within 3 business days.
8.4. A dispute that is not settled is heard by the court of general jurisdiction at HireHub's location given in the section "HireHub details", and with a sole proprietor by the Moscow Arbitrazh Court.
9. Term and changes
9.1. The contract remains in force until terminated. Either party may withdraw from it by notifying the other through the Platform. By then the parties complete settlements for accepted Tasks.
9.2. HireHub may change the offer by publishing a new version with its effective date. If the changes are material, the Platform asks the Specialist to accept the new version before the next action that requires it. Tasks started before the change are performed on the previous terms.
10. Simple electronic signature
10.1. The parties use a simple electronic signature. The signature key is access to the Account or to the Telegram account linked to it. An action taken after signing in to the Account or confirmed in the Telegram bot is deemed signed.
10.2. Each time a document is accepted, the Platform records the Account identifier, the date and time, the IP address (in the application) and the Telegram user identifier (in the bot). These records are evidence of signing.
10.3. Electronic documents signed with a simple electronic signature are equivalent to paper documents signed by hand.
11. Notices
11.1. HireHub sends legally significant messages to the Account or to the Telegram bot. A message is deemed received on the day it is sent.
11.2. The Specialist sends messages to HireHub through Platform support or to atmpotn@yandex.ru.
